The basis for an AOC results in Europe from various EU regulations, supplemented by national regulations of the respective member country. To successfully apply for an AOC, there are a number of requirements to meet, such as the following.

Your company should be a separate legal entity that is majority owned by individuals or companies within the EU. The location of the company determines the responsibility of the respective aviation authority.

Another requirement for the authorization to carry out commercial air transport is proof of sufficient capital. This is not a one-off requirement for obtaining the operating license, but a continuous requirement: the economic performance must be continuously demonstrated in order to maintain the AOC.

Air law provides for seven executive and supervisory responsibilities within air operators. Under certain conditions, especially in small businesses, certain functions may be consolidated to one person. The management personnel is subject to strict legal requirements concerning both training and professional experience as well as the pursuit of activities. In aviation there are many rules and obligations. All measures to maintain and enforce safety are to be documented in an Air Carrier Security Exposure; the measures taken in the event of an incident or accident must be documented in an Emergency Response Plan. Procedures to ensure compliance with legal requirements and to monitor and improve flight safety must be established and documented.
